The MOOD FABRIC SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE U.S., INCLUDING THE DISTRICT OF COLUMBIA, WHO ARE ABOVE THE AGE OF MAJORITY IN THE STATE OR TERRITORY IN WHICH THEY RESIDE AT THE TIME OF ENTRY. VOID WHERE PROHIBITED BY LAW.
Sponsor: MOOD FABRICS ("Sponsor").
Term: The $250 MOOD FABRIC'S Gift Card Sweepstakes ("Sweepstakes") begins on JUNE 1, 2011, at 9:00 a.m. EASTERN Standard Time (EST). A MONTHLY Sweepstakes will be held for each calendar month during the Term. Mood Fabrics may cancel or revise the Sweepstakes at anytime.
Eligibility: Sweepstakes is open to all legal residents of the 50 United States and the District of Columbia , who are above the age of majority in the state or territory in which they reside at the time of entry. Void where prohibited. Employees of Mood Fabrics and its affiliated companies and members of the immediate families of each are not eligible. Sweepstakes is subject to all local, state and federal laws and regulations. By entering this Sweepstakes, all entrants agree to comply with and be bound by these Official Rules, and to comply with all federal, state and local laws and regulations.
How To Enter: Purchase is not necessary to take the survey but is necessary to enter or win the Sweepstakes because we need information to contact you such as email, name and phone number.
A. Internet Entry
1) You can complete the survey at MoodFabrics.com/MoodExperience at any time during the Term by providing the information requested. Once the survey is completed, enter your name, phone number and email address and click on the "submit" button and you will automatically receive one (1) entry.
Prizes: Sponsor will award one (1) winner one (1) $250 Mood Fabric Gift Card every 30 days through each calendar year. Sweepstakes can only be used in a Mood Fabric retail location.
Winner Selection: Potential winner(s) will be selected in a random drawing from among all eligible entries received for each month during the Term on or about the fifth (5th) business day of the month immediately following the end of each month during the Term, from among all eligible entries received throughout the Term. Potential winners will be contacted by e-mail or by phone at the e-mail address or phone number provided on the registration page or the mail-in entry. Winners will be required to complete, sign and return an Affidavit of Eligibility, a Liability Release, and, where lawful, a Publicity Release within four (4) calendar days of notification. Failure to return the documents and/or requested information, or the return of any prize or prize notification as undeliverable, or if a winner is found to be ineligible or otherwise not in compliance with these Official Rules, the prize will be forfeited and an alternate winner may be selected in a random drawing from among all remaining eligible entries.
Prize Restrictions: Limit one (1) prize per individual/household during the Term. Prizes are non-transferable, and no substitutions are allowed except by Sponsor, who reserves the right to award a prize of equal or greater value, should the prize become unavailable for any reason. Any and all taxes and costs associated with the receipt and use of the prize are the responsibility of the winner. By accepting any prize, winners consent to use of his/her name or likeness for advertising/publicity purposes without further consideration, except where prohibited by law.
Privacy: Any information collected will be subject to Sponsor's Privacy Policy, located Here privacy (the "Policy"). By entering the Sweepstakes, you acknowledge that you have agreed to such Policy and you consent to the collection, use and disclosure of your personal information for the purposes of administering this Sweepstakes in accordance with such Policy. If you wish to access or correct your personal information held by us, opt out of receiving further communications from us or our affiliated merchants or companies, or have other questions respecting our privacy policy, please contact us at Sweepstakes@MoodFabrics.com.
Conduct: By participating, entrants agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Entrants further agree to comply with and be bound by decisions of Sponsor, which shall be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any Sponsor web site; (b) violating these Official Rules; (c) violating the Official Rules of service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
Release and Limitation of Liability. By entering, participants release and hold harmless Sponsor, respective parent, subsidiaries, affiliates, directors, officers, employees and related entities (collectively, "Releasees") from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property that may be sustained in connection with the receipt, ownership, or use of the prize from or arising out of participation in this Sweepstakes. Sponsor assumes no responsibility or liability for (1) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (2) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (3) any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes; (4) technical or human error which may occur in the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize.
Internet: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Sweepstakes.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Online entry can only be made via one (1) e-mail address per person. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Force Majeure: The failure of the Releasees to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of the Releasees (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
Disputes: Except where prohibited or otherwise outlined in these Official Rules, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Texas State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of NY, without giving effect to any choice of law or conflict of law rules (whether of the State of NY or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
